Family Continues Their Fight for Justice Following Avoidable Death at Spire Hospital

An inquest in 2024 found that Phillip Morris’ death was avoidable. Spire, the private healthcare provider who was responsible for his care along with others, have not yet settled the family’s claim.

The case has returned to national attention this week, and we continue to represent Phillip’s family as they seek accountability for the failures in care that led to his death.

Phillip, a much‑loved husband, father and respected figure within the Welsh arts community, underwent private surgery at Spire during a period when NHS elective procedures had been paused. After the operation, his health deteriorated over several days whilst he remained in their care, before he passed away.

We represented the family in the inquest, after which the Coroner concluded that Phillip’s death was avoidable. Evidence heard during the inquest highlighted multiple failures in monitoring and managing his condition, including the non‑functioning of essential respiratory equipment during attempts to intubate him.

Two years on, the claim remains unresolved despite repeated efforts to reach a settlement. As this week’s media reporting reflect, the ongoing delays have significantly affected Phillip’s wife and their son, Orson, who has spoken publicly about the impact the lack of closure has had on his wellbeing and daily life – see ITV interview.
